Council Extends Moratorium Prohibiting the Establishment of Medical Marijuana Dispensaries Within the City

At its June 1st City Council meeting, the Laguna Niguel City Council adopted an Interim Urgency Ordinance, extending for one year, the moratorium on the establishment of medical marijuana dispensaries within the City. The action allows staff additional time to study and consider the enactment of regulations pertaining to medical marijuana dispensaries.

City Attorney Terry Dixon presented the staff report and stated that staff continues to gather information from other cities on their approach to prohibiting and regulating medical marijuana dispensaries. His office will continue to monitor litigation concerning the authority of cities to regulate and prohibit medical marijuana dispensaries. The ordinance goes into effect upon adoption by the City Council and will remain in effect until July 6, 2011.

Council Goes On Record Supporting the California Jobs Initiative

In a unanimous vote of the City Council on Tuesday night, the City went on record supporting the California Jobs Initiative. If approved by the voters, the California Jobs Initiative would require the suspension of AB 32 (California Global Warming Solutions Act of 2006). With California in the midst of a severe economic recession, the implementation of AB 32 would impose significant additional costs on California cities and counties, and would further reduce economic activity resulting in more than one million lost jobs. The Council also directed staff to prepare a letter for the Mayor’s signature to be sent to Governor Schwarzenegger requesting that he exercise his executive authority and suspend the implementation of AB 32.
